Filing For Personal Bankruptcy California

How do I know if I am a regular employee or an independent contractor?
I am an engineer that relocate to California for a company that was starting. They never give me a regular paycheck. I received personal checks or wireless transfers whenever they had money (no more than 5 times). This company filed bankruptcy so I had to find myself a new job. Now after many months they send me a 1099. Is this beneficiary for me? Do I need to pay taxes for what they gave me? How do I know if they are doing the right thing? Or even more, how do I know if I was a regular employee or an independent contractor?
hopefully someone will answer me this. Because I think they are trying to trick me
If your were an independent contractor you should have a contract signed by you and your employer stating your independent contractor status. Independent contractor have to pay all of their own social security taxes which will add an additional 13.5% tax to your payroll taxes made at that company.
If you were included in the company benefit package or if the company withheld any payroll taxes when you worked there you probably would be considered an employee and not a contract.
