A statewide class action has been filed in New York against collection specialists, Cohen & Slamowitz. The action is brought on behalf of all New York residents who received form type collection letters from the firm and/or who have been alleged victims of the firm’s alleged harassing collection tactics. The action is brought under the federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief.
They are allowed to contact you to tell you they are going to take legal action. But if it’s to convince you to pay and not in the nature of notice of the garnish, then it is harassment and that is what your post describes. You need to contact the attorney that is suing them under the action is brought on behalf of all New York residents who received form type collection letters from the firm and/or who have been alleged victims of the firm’s alleged harassing collection tactics.
Your debt should be paid by Cohen & Slamowitz. That is to say that at least the settlement or convictions will clear your debt because they nullified the ability to collect. The creditor will have to sue Cohen & Slamowitz. for that debt in were as a person sues their lawyer for malpractice when they lose their money. Once malpractice is the issue, the lawyer pays cost, which would be your debt. The case cannot be started over again against you. You will be out of the picture for ever once it is passed to Cohen & Slamowitz.
You have to get your name and account on the witness list. These lawyers usually don’t charge you any fees to join the class action.
