Should I file a wage claim against my former employer?
During the months of September and October of 2009, I worked for a woman as an independent contractor. I had a contract, which said that for my work done in Sept., I would receive payment on 10/31, and for my work done in October, I would receive payment on 11/30. I have yet to receive payment for any of my time worked (she owes me about $600). I asked her when she would pay me, and she told me “when she has the money”, and made me feel bad about asking, saying that she was unable to pay her bills or rent for the past 2 months. However, I had a contract, did my work, and think that I deserve to get paid. I told her that if I was not paid by 12/31, I would file a wage claim, and she told me that I was “vindictive” and would not get any money because she would declare bankruptcy. Will I ever get my money? Should I file the claim?
If the woman is an employer who owns a business and you did work for her, then you can file a claim with the states labor board. Let her know you plan to do so and if she does not pay you, then she will also be penalized with a hefty fine. It is not being vindictive to ask to be paid for work completed.
If she was just some woman you did some work for, you will have to file a small claims suit in order to try and get your money.
Nobody is going to declare bankruptcy over a $600 debt. Sounds like she is just stringing you along as long as she can.
Next time, if you are not paid timely the first month, do not continue to work.
