Bankruptcy In Florida Chapter 13
I live in Hollywood florida.?
Our house went up for Shariff’s Sale today. The House did not sell and went back to the bank. How long do we have before we have to move and what other options are there for us to secure the house? Should I declair bankruptcy under chapter 13? If not how should I proceed?
laws vary widely from state to state. you need to consult a bankruptcy attorney- many will give a free consulataion. in some states, once the house goes to auction you have a certain time period, called a redemption period, in which you can redeem the house by paying what you owe- in other words refinancing to pay what the mortgage company says is owed. some states this is as little as 15 days, some as long as six months. since the house already went to auction, bankruptcy won;t do anything to save the house. if you don;t want to try and stay in the house you may want to wait on filing bankruptcy. if your bank can;t sell the house for the amount you owed them they can come after you for a deficiency judgement. that would be the time to look into a bankruptcy if necessary.
