Considering bankruptcy .. Nevada Need some advice?

I went bankrupt when I lived in California in 2003. I put in another financial bind and I am forced to consider doing so again. Now I live in Nevada and was informed by a bankruptcy lawyer in Nevada, said that since he had less than 8 years I would have to file Chapter 13. Does anyone know if this provision is for any in what state? And since I live in Nevada, I do deposit Nevada, or it may occur in California?
